TERMS OF SERVICE

These Terms of Service govern your access to and use of the Together Always online store and your purchase of products from us.
By using the store or placing an order, you agree to these Terms of Service.
Please read them carefully before completing a purchase.
1. About Together Always
Together Always operates an online retail store serving customers in the United Kingdom.

2. Application of These Terms
These terms apply to purchases made through the Together Always Shopify store.
Additional policies, including our Returns and Refunds Policy, Privacy Policy and Shipping Policy, form part of these terms where applicable.
If there is any conflict between these terms and mandatory UK consumer law, mandatory consumer law will prevail.
3. Eligibility to Purchase
To place an order, you must:
- Have legal capacity to enter into a binding contract;
- Provide accurate and complete information;
- Be authorised to use the selected payment method;
- Comply with these terms and applicable law.
If you are under 18, you should place an order only with the involvement and permission of a parent or legal guardian.
4. Product Information
Together Always takes reasonable care to ensure that product descriptions, images, specifications, sizes and prices are accurate.
However:
- Colours may appear differently depending on the device, screen and display settings;
- Product packaging may differ from images;
- Minor variations may occur where products are handmade or manufactured in different batches;
- Measurements may be approximate;
- Product availability may change without notice.
These provisions do not permit Together Always to supply a product that is materially different from its description or to limit your statutory rights.
You are responsible for reviewing product information, size guides and compatibility details before ordering.
5. Prices and Currency
All prices displayed by Together Always are in pounds sterling (£), unless clearly stated otherwise.
Prices may include applicable UK taxes where required.
Delivery charges and any other applicable costs will be displayed before you submit the order.
Together Always may change prices at any time. A price change will not normally affect an order that has already been accepted.
If an obvious pricing error occurs, we may contact you before accepting or dispatching the order. You may choose to proceed at the correct price or cancel the order for a full refund.
We will not rely on this provision to avoid a valid order merely because a later price is less favourable to us.
6. Placing an Order
An order is placed when you complete the checkout process and submit payment details.
After placing an order, you may receive an automated acknowledgement. This acknowledgement confirms receipt of the order but does not necessarily mean that the order has been accepted.
A contract is formed when Together Always sends confirmation that the order has been accepted or dispatches the products, whichever occurs first.
We may decline or cancel an order before acceptance where reasonably necessary, including where:
- A product is unavailable;
- Payment is not authorised;
- Fraud or misuse is suspected;
- An obvious pricing or description error has occurred;
- Delivery cannot be completed to the supplied address;
- The order breaches these terms or applicable law.
If payment has already been taken for an order that we do not accept, the relevant amount will be refunded.
7. Payment
Payment must be made using a payment method offered at checkout.
By submitting payment information, you confirm that:
- The information is accurate;
- You are authorised to use the payment method;
- Sufficient funds or credit are available;
- The payment provider may perform security and verification checks.
Payments may be processed by Shopify Payments or another third-party payment provider.
Together Always is not responsible for charges imposed independently by your bank, card issuer or payment provider, including currency conversion or international transaction charges.
8. Discount Codes and Promotions
Discount codes and promotions:
- Must be used within the stated validity period;
- May be subject to eligibility requirements;
- May be limited to particular products, customers or order values;
- Cannot normally be exchanged for cash;
- Cannot normally be combined unless expressly stated;
- May be cancelled where obtained or used fraudulently;
- Apply only to qualifying purchases.
Only one discount code may be used per order unless Together Always expressly permits otherwise.
Where a refund relates to a discounted purchase, the refund will be based on the amount actually paid.
Where part of a multi-buy or bundle order is returned, the promotion may be recalculated based on the products kept.
9. Product Availability
All orders are subject to availability.
Adding a product to your basket does not reserve it.
If a product becomes unavailable after an order is placed, we may:
- Offer a suitable alternative with your agreement;
- Dispatch the available portion of an order with your agreement;
- Cancel the unavailable product and issue a refund;
- Cancel the entire order and issue a refund where appropriate.
We will not substitute a materially different product without your agreement.
10. Delivery
Delivery is governed by the Together Always Shipping Policy.
Estimated delivery dates are estimates unless we expressly agree to a guaranteed date.
Together Always will deliver products without undue delay and, unless another period has been agreed, normally within 30 days after the contract is formed.
If delivery is materially delayed, you may have rights under the Consumer Rights Act 2015, including the right to set an additional reasonable deadline or, in certain circumstances, end the contract.
Risk of loss or damage normally passes to you when you, or a person identified by you, takes physical possession of the products.
Where you independently arrange for a carrier that was not offered by Together Always, risk may pass when the product is delivered to that carrier, as permitted by law.
11. Delivery Information Supplied by You
You must provide a complete and accurate delivery address.
Together Always is not responsible for delays caused by inaccurate or incomplete information supplied by the customer, except where we failed to act with reasonable care.
Contact us promptly if you identify an error. We cannot guarantee that an address can be changed after processing or dispatch begins.
Additional costs caused by an incorrect address, failed delivery or refusal may be charged or deducted from a refund where reasonable and lawful.
12. Ownership of Products
Ownership of products passes to you when Together Always has received payment in full and the products have been delivered, subject to applicable law.
13. Cancellation, Returns and Refunds
Your rights relating to cancellations, returns, faulty products and refunds are explained in the Together Always Returns and Refunds Policy.
Nothing in these terms removes or reduces rights available under the Consumer Contracts Regulations 2013 or Consumer Rights Act 2015.
14. Your Responsibilities
You agree not to:
- Use the store for unlawful or fraudulent purposes;
- Submit false or misleading information;
- Attempt to gain unauthorised access to the store;
- Introduce viruses, malware or harmful code;
- Interfere with store operation or security;
- Scrape, copy or extract store content through automated means without permission;
- Impersonate another person;
- Use another person’s payment details without authority;
- Infringe intellectual-property or privacy rights;
- Place orders for unauthorised resale where restrictions have been clearly disclosed.
We may suspend or restrict access where reasonably necessary to protect the store, customers or third parties.
15. Intellectual Property
Unless otherwise stated, the content of the Together Always store is owned by, licensed to or lawfully used by Together Always.
This may include:
- Brand names;
- Logos;
- Product photographs;
- Videos;
- Graphics;
- Written content;
- Layouts;
- Designs;
- Software;
- Product descriptions.
You may access and use the store for personal, non-commercial shopping purposes.
You must not copy, reproduce, publish, sell, distribute, modify or commercially exploit protected content without prior written permission, except where permitted by law.
Third-party trade marks remain the property of their respective owners.
16. Customer Reviews and Submitted Content
If you submit a review, photograph, comment or other content, you confirm that:
- You have the right to submit it;
- It is accurate to the best of your knowledge;
- It does not infringe another person’s rights;
- It is not unlawful, defamatory, abusive, discriminatory or misleading;
- It does not contain malicious code;
- It does not disclose another person’s private information without permission.
You grant Together Always a non-exclusive, worldwide, royalty-free licence to use, reproduce, adapt and display submitted content for operating and promoting the store, subject to applicable privacy and consumer law.
We may remove content that breaches these terms or applicable law.
We will not knowingly publish fake reviews or materially alter a review in a misleading way.
17. Third-Party Services and Links
The store may use or link to third-party services, including:
- Shopify;
- Payment providers;
- Delivery tracking services;
- Social-media platforms;
- Analytics services;
- External websites.
Third-party services may be governed by their own terms and privacy policies.
Together Always is not responsible for a third party’s independent acts, content or systems, except where the law makes us responsible.
18. Liability
Together Always does not exclude or limit liability where doing so would be unlawful.
Nothing in these terms excludes or limits liability for:
- Death or personal injury caused by negligence;
- Fraud or fraudulent misrepresentation;
- Breach of statutory rights relating to products;
- Defective products where liability cannot lawfully be excluded;
- Any other liability that cannot be excluded under UK law.
Together Always is responsible for foreseeable loss or damage caused by our breach of contract or failure to use reasonable care and skill.
Loss or damage is foreseeable where it was an obvious consequence of the breach or was contemplated by both parties when the contract was formed.
Together Always is not responsible for loss that was not foreseeable, caused by your own breach, or caused by circumstances outside our reasonable control, subject to your statutory rights.
The store and products are supplied primarily for domestic and private use. If you use products for commercial, business or resale purposes, Together Always will not normally be responsible for business losses such as lost profit, revenue, opportunity or data, except where liability cannot lawfully be excluded.
19. Events Outside Our Reasonable Control
Together Always will not be responsible for delay or failure caused by events outside our reasonable control, such as:
- Severe weather;
- Natural disasters;
- Epidemics or public-health emergencies;
- War, terrorism or civil disorder;
- Industrial action;
- Transport disruption;
- Customs delays;
- Failure of telecommunications or payment networks;
- Government action;
- Widespread supplier or carrier disruption.
We will take reasonable steps to minimise the effect of the event and resume performance.
This section does not remove any right you may have to cancel because of delay or non-performance.

- Your name;
- Order number;
- A clear description of the issue;
- Any supporting evidence;
- The outcome you are seeking.
We will review complaints fairly and aim to respond within a reasonable period.
21. Changes to These Terms
Together Always may update these terms for legal, operational, technical or commercial reasons.
The terms applying to an order will normally be those in effect when the order is placed.
Material changes will be published on the store with an updated revision date.
22. Severability
If any provision of these terms is found to be unlawful, invalid or unenforceable, that provision will be treated as modified or removed to the minimum extent necessary.
The remaining provisions will continue in effect.
23. No Waiver
If Together Always does not immediately enforce a right, this does not mean that the right has been waived.
A waiver will be effective only where clearly communicated.
24. Entire Agreement
These terms, together with the policies referred to in them and the information confirmed during checkout, form the agreement between you and Together Always in relation to the relevant purchase.
Nothing in this section excludes liability for fraud or prevents reliance on statements that legally form part of the contract.
25. Third-Party Rights
Unless expressly stated, a person who is not a party to the contract has no right to enforce these terms under the Contracts (Rights of Third Parties) Act 1999.
This does not affect any right or remedy available independently of that Act.
26. Governing Law and Jurisdiction
These terms are governed by the laws applicable in the part of the United Kingdom in which you live.
If you are a consumer living in:
- England or Wales, you may bring proceedings in the courts of England and Wales;
- Scotland, you may bring proceedings in the Scottish courts;
- Northern Ireland, you may bring proceedings in the courts of Northern Ireland.
Nothing in this section removes any mandatory consumer protection available to you.
